In England, Biodiversity Net Gain is now a legal requirement for developers seeking planning permission. This is not a voluntary ESG trend or a "nice-to-have" option; it is a statutory planning condition.

The regulation has been phased in as follows:

  • February 2024: Mandatory for all major developments (defined as 10+ dwellings or sites larger than 0.5 hectares).

  • March 2026: Expanded to cover Nationally Significant Infrastructure Projects (NSIPs).

Under the rules, developers must prove they will increase the site's ecological value by at least 10% compared to its pre-development baseline. The assessment must use the statutory biodiversity metric. The gained habitats must be secured and managed for a minimum commitment of 30 years.
